Making an application
Under the Justice & Security Act 2007, the Compensation Agency can consider claims for damage or loss suffered as a result of action by PSNI or Army, while searching for items which may be useful to terrorist organisations. This will normally be indicated on the Premises Search Record provided by the police or the army at the time of the search.
You should contact Criminal Damage Branch of the Compensation Agency on:
028 90547335
028 90547381
028 90547360
They will ask for the following information:-
- Names of applicants
- Addresses of applicants
- Dates of birth of applicants
- Contact telephone number
- National Insurance number
- Details of the property damaged ie. address along with type of damage caused, for example – windows, doors decoration
- Name and address of owner of property, if different from applicant
- Date of damage – claims should be with the Compensation Agency within 28 days from the date of the incident
- Names and addresses of loss assessor and solicitor, if applicable – however, under this legislation the onus for these expenses falls to the applicant regardless of whether liability is accepted or not. These claims can be processed without the services of a solicitor or loss assessor
- VAT status – registered or not registered
Once you have completed your call to Criminal Damage branch, we will register your claim and issue an Application form (C2) to either your solicitor or yourself. We also appoint a loss adjuster/motor engineer as appropriate, who will normally contact you on the contact telephone number provided by you.
We will also, if requested, issue a copy of our Guidebook, which explains this legislation, although this can be viewed on our website prior to making an application, and this is highly recommended.
